Identification  

The “We Drive EU” campaign is an independent awareness and advocacy initiative supporting the automotive aftermarket sector within the European Union (hereinafter the “Campaign”). The Campaign is owned and run by the Fédération Internationale des Grossistes, Importateurs et Exportateurs en Fournitures Automobiles (“FIGIEFA”), an international non-profit association, with registered seat at Woluwedal 42/5, 1200 Sint-Lambrechts-Woluwe, Belgium (0472.205.007) as single point of contact for and on behalf of the Automotive Coalition for Europe coalition partners: Automotive Data Publishers’ Association (ADPA), Association Internationale des Réparateurs en Carrosserie (AIRC), Automotive Mobility Europe (AME), European Garage Equipment Association (EGEA), and Insurance Europe, together the “Automotive Coalition for Europe”.  

Content 

All content published through the Campaign, including texts, statements, figures, market data, statistics, estimates, forecasts, economic analyses, projections, graphics, photographs, videos, social media content, leaflets, presentations, and other materials (hereinafter the “Content”) is provided in good faith and for general informational and public policy discussion purposes only. The views and opinions expressed within the Content are therefore intended solely to contribute to public debate and policy discussions. They do not constitute legal, technical, regulatory, investment, and/or professional advice. 

Figures, market data, statistics, estimates, forecasts, and economic analyses used within the Content rely on publicly available information, industry sources, third-party studies, stakeholder contributions, and following an analysis of Wolk & Nikolic Aftersales Intelligence. Such information may be subject to differing methodologies, assumptions, interpretations, updates, revisions, or alternative assessments. 

While reasonable efforts are made to ensure the accuracy, completeness, relevance, reliability, validity, and timeliness of the Content, FIGIEFA and the Automotive Coalition for Europe make no representation or warranty, express or implied, regarding the absolute accuracy, completeness, relevance, reliability, validity or timeliness of all of the Content. All the Content is therefore for provided “as-is”.  FIGIEFA and the Automotive Coalition for Europe do not guarantee or warrant that all Content will continue to be available indefinitely.  

Any possible inadvertent inaccuracies, omissions, or outdated information are entirely unintentional and do not constitute deliberate misrepresentation, deception, or negligence. 

Nothing in the Campaign is intended to unlawfully harm the reputation, rights, or commercial interests of any individual, company, institution, organisation, or stakeholder. References to third-party companies, brands, products, services, trademarks, institutions, public authorities, or public figures are made solely for identification, commentary, informational, comparative, or illustrative purposes. All trademarks, logos, images, and intellectual property rights remain the property of their respective owners.  

This website may contain links to third-party websites or resources. These links are provided for convenience and informational purposes only. FIGIEFA and the Automotive Coalition for Europe are not responsible for any content provided or promoted by third parties. 

FIGIEFA and the Automotive Coalition for Europe do not guarantee uninterrupted, error-free, or secure access to the website or digital Content at all times. The website or digital Content can be unavailable due to force majeure or due to an action taken by the Automotive Coalition for Europe. We reserve the right to suspend, restrict, or terminate access to any part of the website or digital Content at any time without notice (e.g. for maintenance purposes, or updates to the website or the Content). In such case, access will be restored as soon as reasonably possible. 

Intellectual property rights 

All intellectual property rights, including but not limited to copyright, databases, trademark, tradenames, designs and drawings, or any other right, whether registered or unregistered, in the Content and the Campaign (including the Campaign logo, slogan or name) are the exclusive property of FIGIEFA, or its licensors, as the case may be. 

The user receives a worldwide, non-exclusive, non-transferable, non-sublicensable, royalty-free license to view and download solely for personal and non-commercial informational purposes only . If a user wishes to use the Contents for other than personal and non-commercial information purposes, he/she shall contact FIGIEFA. 

The user represents and warrants that its use will comply with the license terms and that it will not use the Content in a way that infringes applicable intellectual property rights.  

FIGIEFA and the Automotive Coalition for Europe, on its own behalf of the relevant author if so mandated, will have the right to object to any modifications, including but not limited to modifications that are misleading or defamatory. Each individual author may also object to any modification directly. 

Certain Content may include trademarks, logos, trade names, product names, images, photographs, excerpts, institutional references, or third-party materials, which remain the property of their respective owners and are used solely for identification, commentary, comparison, informational, illustrative, or public-interest purposes. Appropriate attribution will be given. 

The inclusion of any third-party intellectual property does not imply ownership, endorsement, affiliation, sponsorship, or approval by the respective rights holders unless expressly stated. 

Any licenses provided herein are of an unlimited duration. In the event FIGIEFA and the Automotive Coalition for Europe detects use in violation of these terms and conditions, FIGIEFA and the Automotive Coalition for Europe have the right to suspend or terminate the license by sending a notice to the user by any means that it deems appropriate (e.g. e-mail or (registered) mail). As from the moment of receipt of the notice, the user will cease any use of the Content and will, as applicable, remedy the default, or delete any Content. The foregoing is without prejudice to FIGIEFA’s and the Automotive Coalition for Europe’s rights to claim damages or exercise any other remedy available under intellectual property law or general law. 

The aforementioned license applies to the extent no separate license is attached to the Content. In the event of a specific, separate license attached to the Content, that license will prevail over the general license mentioned herein. 

Remedies 

Should any person or entity believe that the Content published by the Campaign is inaccurate, misleading, incomplete, or requires clarification or correction, or is used in violation of applicable intellectual property rights, they are invited to contact FIGIEFA, as representative of the Automotive Coalition for Europe, at the below e-mail address. The Automotive Coalition for Europe undertakes reasonable efforts to review the matter promptly and, where appropriate, correct, update, clarify, or remove the material, as appropriate. 

To the fullest extent permitted by applicable law, FIGIEFA and the Automotive Coalition for Europe shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with access to, use of, or reliance on any Content published through the Campaign. The Automotive Coalition for Europe cannot exclude its liability for gross negligence, fraud or death/personal injury.  

FIGIEFA and the Automotive Coalition of Europe are not liable for any third-party content linked on the website, or made available as part of the Content. 

Miscellaneous 

By accessing or using the Content, users acknowledge they have been able to take note of these terms and conditions and to accept these terms and conditions. The Automotive Coalition for Europe reserves the right to amend, update, or replace these terms and conditions at any time. The date of last update can be found at the bottom of this page. Any amended, updated, or replaced terms shall become applicable as from the date mentioned at the top of this page. 

If any provision of these terms and conditions are found to be invalid, unlawful, or unenforceable under the applicable law, such provision shall be deemed severed from the remainder of the terms and conditions, which shall continue in full force and effect. Any invalid, unlawful, or unenforceable clause will be replaced by a valid clause that most closely reflects the original intent.

These terms and conditions are governed by and shall be construed in accordance with the laws of Belgium. Any possible disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the competent French speaking courts of Brussels.
